1. Parties

Thalia Ontiveros ("the Provider"), located at Guerrero #402, Colonia Centro, Oaxaca de Juárez, Oaxaca, Mexico, ZIP 68000, email hola@thaliaontiveros.com; and the visitor, buyer, student or client ("the User").

2. Acceptance

By using the website, sending forms, signing up, buying or ticking an acceptance box, you confirm that you have read and accept these terms, that you have legal capacity and that the information you provide is true. Electronic acceptance is valid under the law.

3. Related documents and order of precedence

The Privacy notice, Cookie policy, Cancellations and refunds policy, Intellectual property policy, the conditions of each sales page and individual proposals or contracts are part of these terms. In case of conflict, the order is: mandatory law, individual contract, product conditions and, lastly, these general terms.

4. Products and services

  • Training: online and in-person courses, workshops, webinars, keynotes, memberships and communities.
  • Digital resources: ebooks, guides, manuals, templates and prompts.
  • Consulting: 1:1 consulting, mentoring, diagnostics, strategy sessions and audits.
  • Marketing and sales: ad campaigns, sales strategies for WhatsApp, social media and websites, funnels, launches and email sequences.
  • Automation and AI: chatbots, ManyChat, WhatsApp setup, lead automation and artificial intelligence implementation.
  • Website design.

The scope, price, duration and format of each are stated on its sales page, proposal or contract.

5. Information, prices and promotions

Prices may be in Mexican pesos, U.S. dollars or another clearly identified currency. There may be costs outside the Provider's control, such as currency conversion, bank fees, taxes or interest. Prices may change for future purchases, never for confirmed orders. Promotions cannot be combined or exchanged for cash unless stated otherwise. Images, testimonials and demos are illustrative.

6. Purchase, payment and invoicing

A purchase is confirmed when the payment processor authorizes it and a confirmation is issued. Payments are processed by external platforms such as Hotmart or Mercado Pago, which also apply their own terms. The Provider does not store card numbers or banking passwords. If you need an invoice, request it within the applicable tax deadline by sending your correct details to hola@thaliaontiveros.com.

7. Digital delivery and license

Products are delivered by email, download link, learning platform, Hotmart or the channel stated in the offer. You are responsible for providing a correct email, checking spam, protecting your credentials and having a compatible device and connection. You receive a personal, limited, non-exclusive, non-transferable license; no copyright is transferred. See the Intellectual property policy.

8. Access duration and updates

The access duration is stated on the sales page. "Lifetime access" means for as long as the product and platform operate and the Provider has the right to distribute it. Materials may be updated, corrected or reorganized; updates do not imply new sessions or additional coaching.

9. Live and in-person events

Dates and rules are communicated in advance. Punctuality, respect and no recording or streaming are expected. Schedules, speakers, platforms or venues may change for justified reasons, with prior notice.

10. Consulting and custom services

You must provide truthful, sufficient and timely information. Late arrival reduces session time without changing the price. Booking a session does not oblige you to hire other services. Custom services may require a proposal, contract, deposit, access, approvals and a schedule; additional work is quoted separately.

11. Ad budget and account access

Fees do not include the budget paid directly to Meta, Google, TikTok or other platforms. The client funds their ads, keeps their payment methods valid and complies with each platform's policies. Collaborator role access is recommended instead of sharing passwords; the client keeps ownership of their accounts and must remove access when the service ends.

12. Third-party platforms and artificial intelligence

Services depend on tools such as Hotmart, Meta, WhatsApp, ManyChat, Google, Calendly, Mercado Pago, email and AI providers, which may change features, prices or policies, or suspend accounts. The Provider does not guarantee their availability or decisions. AI-generated results may be incomplete or incorrect and must be reviewed before use; they do not replace legal, tax, accounting, medical or financial advice.

13. User obligations

Use the website lawfully, provide true information, pay as agreed, respect intellectual property and do not interfere with the website, attempt unauthorized access, distribute malware, impersonate others, commit fraud, harass or scrape data with bots. Communities require respectful communication and sharing program materials is prohibited.

14. Intellectual property and testimonials

All content, brand, materials, templates, strategies and methods are protected. Testimonials reflect real experiences and are not a guarantee of results; authorization is requested to publish identifiable details.

15. No guarantee of results

Sales, income, number of clients, ad approval, social media growth or return on investment are not guaranteed. Results depend on the offer, market, price, budget, competition, execution and platform decisions. The content is educational and does not constitute legal, tax, financial or investment advice.

16. Cancellations and refunds

They are governed by the Cancellations and refunds policy, the sales page conditions, the guarantee set on Hotmart where applicable, individual contracts and applicable law.

17. Access suspension and chargebacks

Access may be suspended in case of reasonable suspicion of fraud, abusive chargebacks, shared credentials, resale, cyberattacks or serious breaches. Please contact support before starting a chargeback; genuinely unauthorized or duplicate charges can always be disputed.

18. Website availability

Maintenance, updates, technical failures, attacks or force majeure may temporarily interrupt the website. Brief interruptions do not give rise to automatic compensation.

19. Privacy and communications

Personal data is processed under the Privacy notice and Cookie policy. You agree to receive necessary service messages (purchase, payment, access, classes, schedule changes, support). Promotional messages require your consent where the law requires it and you can unsubscribe at any time.

20. Confidentiality

Both parties will protect shared business or technical information and use it only for the working relationship. Projects with sensitive information may require a separate confidentiality agreement.

21. Limitation of liability and force majeure

To the extent permitted by law, the Provider is not liable for misuse of materials, false information, unreviewed decisions, internet or device failures, third-party actions, algorithm changes or suspensions caused by the client. These limitations do not apply to willful misconduct, gross negligence or non-waivable rights. Neither party is liable for delays caused by force majeure; the affected party will give notice and seek a reasonable solution.

22. Changes

These terms may be updated; the current version is published on this page with its date. Changes do not affect transactions already confirmed.

23. Governing law, disputes and jurisdiction

The laws of the United Mexican States apply. In case of any disagreement, please first write to us in good faith at hola@thaliaontiveros.com. Consumers in Mexico may contact the Federal Consumer Protection Agency (PROFECO). Unless mandatory law provides otherwise, the parties submit to the authorities of Oaxaca de Juárez, Mexico. Consumers in other countries keep their mandatory local rights.

24. Final provisions

If any clause is found invalid, the rest remain in force. Not exercising a right immediately does not mean waiving it. You may not assign your access or rights without written authorization. The Spanish version prevails over any translation.
